THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11409 of 2025 ORDER:
Seeking the Court to enlarge the petitioners who is arrayed as accused Nos.3 and 4 in Crime No.268 of 2025 of Malakpet Police Station, Hyderabad, on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 21.07.2025, the defacto complainant lodged a report with the Police stating that he along with Aravind, Hari Shankar, Vishveshwar, was sitting near the Basthi Davakhana opposite line, casually chatting. During this time, two individuals from the same locality, Sai and another unidentified person arrived on a bike, riding rashly. The complainant stopped them and advised Sai to ride slowly, placing his hand on the should of the Sai. Sai reacted aggressively, questioning, "How can you beat me?" and began arguing. Although the complainant and his friends tried to calm him down, Sai refused to listen and left the scene. Shortly afterward, accused Nos.1 to 6 and some others arrived armed with wooden sticks and iron rods. They launched a violent attack using the weapons. As a result of the assault, they
sustained serious injuries on their head and nose and admitted in hospitals and minor injuries to lips, hands and other parts of the body. Basing on the said complaint, Police registered a case vide Crime No.268 of 2025 for the offences punishable under Section 109(1) read with Section 3(5) of BNS. 3.

Shiva Kumar Konne, learned counsel appearing for the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences and has been falsely implicated and that the petitioners were arrested on 23.07.2025 and the substantial portion of the investigation has already been completed. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners by contending that the allegations against the petitioners are serious in nature and considering the gravity of the allegations and that the investigation was still in progress
and that, if released on bail at this stage, the petitioners might tamper with evidence or threaten witnesses, the prosecution prayed the Court to dismiss the criminal petition. 6.
In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is evident that the petitioner were arrested on 23.07.2025 and they were in judicial custody since then, and as of today, the charge sheet has not been filed. Considering the overall facts and circumstances of the case, including the nature of the allegations, the stage of investigation, and the period of incarceration, this Court finds it appropriate to grant bail to the petitioners, subject to the following conditions: i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned VII Additional Chief Judicial Magistrate, Hyderabad at Nampally.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is
earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
