THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 10072 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners-accused Nos.1 and 2 seeking bail in the event of their arrest in connection with Crime No.516 of 2020 on the file of Abdullapurmet Police Station, Cyberabad, Hyderabad, registered for offences punishable under Section 79 of Juvenile Justice Act and Section 14 of Child Labour Act.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The allegation leveled against these petitionersaccused Nos.1 and 2 are that, one minor girl, aged around 11 years, and who was identified as a victim girl, was put to work in the house of these petitioners to take care of their twin children in their house.

On the basis of the complaint, the girl was rescued from the house and she was found with injuries and when questioned, the girl stated that these petitioners have beaten her. However, keeping in view that these petitioners have two infants in their house and need help of their mother, this Court deems it appropriate to grant anticipatory bail to the mother/petitioner No.2 with the following conditions:-

1) The petitioner-Accused No.2 is directed to surrender before the Station House Officer, Abdullapurmet Police Station, Cyberabad, Hyderabad on 14.10.2023.

Upon such surrender, the said Station House Officer shall release petitioner-Accused No.2, on executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner-Accused No. 2 shall appear before the concerned police as and when required for the purpose of investigation.

3) The petitioner-Accused No.2 shall abide by the other conditions stipulated in Section 438(2) of

Cr.P.C and shall co-operate with Investigating Officer in investigating the case. 5.

In sofar as, petitioner-accused No.1 is concerned, this Court is not inclined to grant anticipatory bail to him.

Accordingly, the Criminal Petition is partly allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
