THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10074 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.2 & 3 seeking bail in the event of their arrest in connection with Crime.No.151 of 2023 on the file of Bibinagar Police Station, Rachakonda, registered for the offences under Sections 286 and 336 of IPC and Section 9 (B) (1) (b) of the Explosive Act and Sections 4 & 5 of the Explosives and Substances Act.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

These petitioners are seeking the relief of anticipatory bail on the ground that A-1 was arrested while using explosive substances for leveling the land of these petitioners. 4.

Even according to the confession of A-1 who was found leveling the land, he was doing blasting works for the past 15 years and these petitioners engaged him to level some part of their land. The use of explosive substances is not to the knowledge of these petitioners.

In the said circumstances, these petitioners can be granted the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos.2 & 3 are directed to surrender before the Station House Officer, Bibinagar Police Station, Rachakonda, on or before 20.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioners/Accused Nos.2 and 3 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of four weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
