THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.26541 of 2012 ORDER:
The grievance of the petitioner in this case was that the police authorities were entering into his house at Yakutpura, Hyderabad, without following the procedure laid down by law. Relying on the written instructions received from the SubInspector of Police, Rein Bazaar Police Station, Hyderabad, the learned Assistant Government Pleader for Home stated that rowdy sheets had been opened in the names of the petitioner and his paternal uncle on the file of Rein Bazaar Police Station and that they were involved in various criminal cases. He further stated that externment proceedings were initiated against the petitioner and in the context thereof, notices were sought to be served on the petitioner. To avoid the same, the petitioner was said to have filed this writ petition. Be that as it may.
As the only grievance of the petitioner is that the police authorities were entering into his residential premises without following the due procedure, there is no necessity for this Court to go into the other issues relating to the petitioner's involvement in criminal activity, if any.
In that view of the matter, the writ petition is disposed of directing the police authorities to abide by the due procedure laid down by law in the event they need to enter into the house of the petitioner at Yakutpura, Hyderabad.
Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
