THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24571 of 2018 ORDER:
Heard Mr.G.Ramachandra Reddy for petitioner and the learned Assistant Government Pleader for Revenue. The petitioner prays for the following relief :- " ..... to issue a Writ, order or direction particularly in the nature of Writ of Mandamus directing the respondents to take steps to remove the obstruction/ encroachments made by the 5th respondent on the public road passing from Raju Gunta Kona Tank to Athimenjiripeta in Tamilnadu at Mitta Indlu H/ o Vana Durgapuram Village, Palasamudram Mandal and restore the said road for free passage of the public by declaring the inaction of the respondents 1 to 4 not taking prompt action in the said direction is illegal......." . On 17.07.2018, at the request of respondents, the writ petition was adjourned to today for placing before the Court the steps, if any taken pursuant to representations submitted by petitioner. The Assistant Government Pleader places on record the written instructions dated 17.07.2018.
The written instructions refer to conducting enquiry in ROC No.N/ 2175/ 2018 dated 10.05.2018 with regard to the claim of petitioner and the same is pending before 3rd respondent. As the enquiry is pending before the 3rd respondent, the 3rd respondent is directed to dispose of enquiry pending in ROC No.N/ 2175/ 2018 dated 10.05.2018 within four weeks from the date of receipt of a copy of this order and take necessary steps in
accordance with the orders, he passes for removing encroachment, within four weeks thereafter.
The writ petition is disposed of accordingly. No order as to costs.
