THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA C.M.A.No.222 OF 2012 JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) This appeal is filed by the 38th respondent in I.P.No.12 of 2009 on the file of Senior Civil Judge, Kavali, aggrieved by the order, dated 08.03.2011, passed in I.A.No.138 of 2011 in the said I.P., by which, the Court below has appointed an Interim Receiver to take possession of the 'B' Schedule property for managing as per law. This Court, by order, dated 15.03.2012, suspended the impugned order and such order continued all along. Heard learned counsel for the appellant and learned counsel for respondent No.2.

In this case, it is to be noticed that the appeal itself is directed against the interlocutory order passed as early as on 08.03.2011 and this Court has suspended such order, which continued all along. As the I.P. is of the year 2009, we deem it appropriate to dispose of the appeal by directing the Senior Civil Judge, Kavali, to dispose of the said I.P., if not already disposed of, within a period of four (4) months from the date of receipt of a copy of this order. We further order that the suspension order passed by this Court on 15.03.2012 shall continue to operate till the I.P. is disposed of. Subject to the above, the appeal is disposed of. Miscellaneous Petitions, if any, pending in this appeal, shall stand closed. No costs.
