Smt.D.Shailaja v. Smt.Bhavani Murthu
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE T.RAJANI W.A.M.P.No.711 of 2017 In/And Writ Appeal No.322 of 2017 COMMON JUDGMENT: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan) This appeal is preferred against the order passed by the Learned Single Judge exercising criminal jurisdiction. In the light of the judgment of the Supreme Court in Ram Kishan Fauji vs. State of Haryana (judgment in Civil Appeal No.4288 of 2017 dated 21.03.2017), an appeal under Clause 15 of the Letters Patent does not lie against the order of the Learned Single Judge exercising criminal jurisdiction. We see no reason, therefore, to grant leave to prefer an appeal. W.A.M.P.No.711 of 2017 is, accordingly, dismissed. Consequently, the Writ Appeal shall also stand dismissed. Suffice it to make it clear that this order shall not preclude the appellant from availing such other legal remedies as are available to her in law. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
