Learned counsel for the petitioners submitted that the petitioners may be permitted to withdraw the criminal petition with liberty to raise all his contentions during trial before the Sessions Court. Recording the above submission, the criminal petition is dismissed as withdrawn giving liberty to the petitioner to raise all his contentions during trial before the Sessions Court. However, the Sessions Judge is directed to dispose of both Calendar Case No.1 of 2016 and Sessions Case No.22 of 2015 simultaneously and pronounce judgments in accordance with law approximately on the same time since both the cases arising out of the same incident.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
