THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41923 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the fourth respondent in not registering the complaint against the fifth respondent, even though the petitioner lodged the complaints, dated 21.06.2012, 16.12.2015 and 16.02.2016 as illegal and arbitrary, and consequently, to direct the fourth respondent to register the crime against the fifth respondent and investigate the same.

Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner lodged the complaints, dated 21.06.2012, 16.12.2015 and 16.02.2016 and that the fourth respondent is not registering the complaint of the petitioner and as such, he prays this Court to direct the fourth respondent to register the case against the fifth respondent and take action against him.

Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the fourth respondent to register the complaint of the petitioner if it discloses any cognizable offence, and conduct effective investigation and file final report, if any, in accordance with law.
