HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.4869 of 2015 ORDER :
This criminal petition is filed by the petitioner/A.2 under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.252 of 2013 on the file of the XII Additional Chief Metropolitan Magistrate, City Criminal Courts, Nampally, Hyderabad, for the offences punishable under Sections 403, 406, 420 read with 120-B IPC and Section 66 of the Information Technology Act, 2000.
2. Heard the learned counsel for the petitioner as well as the 1st respondent-State represented by the Public Prosecutor before admission and before ordering any notice to the 2nd respondent and perused the material on record.
3. A perusal of the material falls short for this Court to admit the application under Section 482 Cr.P.C.
4. Having regard to the above, the criminal petition is disposed of giving liberty to the petitioner to submit an application before the learned Magistrate concerned under Section 239 Cr.P.C., if there are any grounds to seek for discharge to decide on own merits from the material of the prosecution. In the event of framing of any charge aggrieved by the petitioner, the remedy is left open to her to file an application before the learned Magistrate under Section 205 Cr.P.C. through Special Vakalat holder
as she is residing at U.S.A. and it is difficult for her to come and attend day-to-day trial and also hearing on charges, the learned Magistrate shall consider by accord permission to represent through Special Vakalat holder with necessary conditions.
5. Miscellaneous petitions pending, if any, shall stand dismissed.
