ORDER
Heard learned counsel for the petitioner and learned Government Pleader for Land Acquisition for respondents.
2. Petitioner in this case claims to be the pattadar of lands in Sy.
Nos.94-3, 94-9, 95-1 and 95-3 of Puchalapalli Village, Kota Mandal, Nellore District, which are stated to be now under the use of pisci culture. Alleging that the respondents are trying to dig a canal through the petitioner's aforesaid land without following due process of law, this writ petition is filed.
3. Learned Government Pleader for Panchayat Raj and Land Acquisition has received instructions. He states that as per the orders of the Sub-Collector, Gudur, survey of the lands in Sy.Nos.95 & 96 was carried out, but there is no plan marked canal in the village map and the location of the canal shown by the villagers was not agreed by the DKT patta holders. It is also stated that the land claimed by the petitioner is shown as DKT patta and the name of the holder is Chillakuru Ravindra Reddy (petitioner herein). It is also stated that the petitioner was informed that the canal was not plan marked one and the revenue authorities also have no right to form the canal in the patta lands without permission of the pattadars and it is stated that after the survey, the lands of the petitioner are not interfere with and the
respondents have not taken any steps for acquisition of the land without informing the petitioner.
4. In view of the above, therefore, the grievance of the petitioner is clearly based on apprehension, which is found to be incorrect. Hence, no further orders are required to be passed in this writ petition. The Writ Petition is accordingly dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
