The allegations in brief are that the petitioner-accused borrowed an amount of Rs.65,000/- from the second respondent on 20.05.2006 for his necessities and on the same day, the petitioner-accused executed a promissory note agreeing to repay the same with interest @ 24% on demand. Subsequently, on repeated oral demands made by the second respondent, the petitioner-accused issued a cheque bearing No.104635 dated 05.07.2006 for an amount of Rs.65,000/- drawn on Union Bank of India, Ucon Plaza, Park Road, Kurnool. It is further alleged that when the second respondent presented the cheque, the same was returned with an endorsement "insufficient funds". The second respondent issued legal notice on 17.07.2006 and on 02.08.2006 through courier service, but the petitioner-accused evaded receiving the said legal notice.

Hence, the present complaint. Learned counsel appearing for the petitioner-accused submits that the second respondent intentionally issued legal notice as required under Section 138 of the Act to the incorrect address of the petitioner-accused and the second respondent wanted to take advantage by giving incorrect address and by depriving the legal right of the petitioner-accused either to reply or opportunity to take action as contemplated under the law. The record and the complaint have been perused. The main case of the petitioner-accused is that statutory notice contemplated under the Act was sent to incorrect address, thereby resulting in deprivation of his right to take appropriate steps in the matter. In the complaint, the address of the petitioner-accused was shown as H.No.

40-815-2B, Srinivasa Nagar, Kurnool and in the registered notice issued on 17.07.2006, the address was shown as H.No.40-814-2B, Srinivasa Nagar, Kurnool. On the postal cover it was shown as H.No.40-814-2B or 7B (there is overwriting on the numerical before the alphabet "B"). Whether it is 7B or 2B, it is difficult to make out. The postal endorsement is to the effect that the postman visited the given address for seven consecutive days and found that the petitioner-accused was continuously absent. It is not endorsed by the Postal Department that the addressee does not reside in the address given on the postal cover. Subsequently, notice has also been sent by the second respondent by way of courier service and the acknowledgment thereof was also filed. It shows that the notice was received by one B.Suvarna on 08.08.2006.

It is not explained as to who the said B.Suvarna is. Therefore, I feel that it is not a fit case to quash the proceedings and it is a matter for evidence to find out whether the notice sent by the second respondent to the petitioner-accused is proper or not. There are no merits in the Criminal Petition and the same is liable to be dismissed. The Criminal Petition is dismissed.
