THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.13657 of 2016 ORDER:
The petitioner, who is accused No.1, filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of his arrest in connection with crime No.121 of 2016 of Women Police Station, Ranga Reddy District, Cyberabad East, registered against the petitioner and two others for the offence punishable under Sections 498A, 506 IPC and Sections 3 and 4 of DP Act. The main ground raised by the learned counsel for the petitioner is that though the petitioner was granted anticipatory bail in Crl.P.No.8123 of 2016 on 24.06.2016, police are taking steps for altering the FIR by adding Section 377 IPC. Learned Additional Public Prosecutor, on instructions, submits that till date there is no alteration of FIR and if such an alteration is required by the Investigation agency, necessary notice will be issued to the petitioner.
At this juncture, learned counsel for the petitioner seeks permission of the Court to withdraw the Criminal Petition with liberty to avail the remedies available under law. Permission, as sought for, is accorded.
Accordingly, the Criminal Petition is dismissed as withdrawn with liberty as prayed for.
