HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Transfer Criminal Petition No.290 of 2013 ORDER:

In this petition filed under Section 407 Cr.P.C, the petitioners/ respondents seek to transfer DVC No.2 of 2012 from the Court of Judicial First Class Magistrate, Nandyal to Judicial First Class Magistrate, Atmakur.

2) Respondent No.1 filed counter and opposed the petition.

3) Heard both sides.

4) It is seen that similar transfer application in Crl.M.P.No.196 of 2013 was moved by the present petitioners before the Principal Sessions Judge, Kurnool and after hearing both sides learned Judge having considered the convenience of the respondent who is a lady, dismissed the said application. There is no reason to defer with the decision of the Principal Sessions Judge, Kurnool.

5) Accordingly, this Transfer Criminal Petition is dismissed but however, following the decision of this Court in Crl.P.Nos.16576 of 2014 and batch dt:16.02.2015, the attendance of the petitioners herein in DVC No.2 of 2012 on the file of Judicial First Class Magistrate, Nandyal is dispensed with except on the occasions when the trial Court specifically requires their attendance.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
