HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.28011 OF 2019 ORDER:

Heard Sri G.Rajesh, learned counsel for the petitioner and Sri B.Mayur Reddy, learned Standing counsel for respondents. With the consent of learned counsel for the respective parties, this Writ Petition is being disposed of at the admission stage. This writ petition is filed seeking the following relief :- ".........Writ of Mandamus to declare the action of the respondent authorities in not paying petitioner pending service benefits and not serving audit report, even after lapse of 4 years of my retirement, inspite of my repeated personal visits followed by written representation dt.15.05.2017 as being illegal, arbitrary and unjust and consequently direct the respondents to pay pending settlement amount to the petitioner herein along with interest at the rate of 18% p.a. and to pass such other order or orders........"

It has been contended by the petitioner that he was an employee of Telangana State Road Transport Corporation (TSRTC) and has retired from service on 30.06.2014 on attaining the age of superannuation. The grievance of the petitioner is that even after lapse of four years of his retirement, the respondents are not paying service benefits to the petitioner. Therefore, the petitioner submitted representation dated 15.05.2017 requesting the respondents to settle his retirement benefits and pensionary benefits. But so far, the respondents have not passed any orders on the said representation.

Learned counsel for the petitioner contends that appropriate orders be passed in this writ petition directing the respondents to

consider the representation submitted by the petitioner on 15.05.2017 and pass appropriate orders in accordance with law. Learned Standing counsel appearing for the respondents contends that the representation copy which is filed by the petitioner does not bear the acknowledgment of the respondents and if the petitioner submits a fresh representation, the respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within two weeks from the date of receipt of a copy of this order staking his claim for service benefits/retiral benefits. Upon such representation being received, the respondents shall consider the same and pass appropriate orders in another eight (08) weeks thereafter.

With the above direction, this writ petition is disposed of. No costs.
