THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2244 of 2014 ORDER:

This Writ Petition is filed for the following relief: "...to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the in action of the 4th respondent has not registered the FIR against the 6th and 7th respondents as per instructions of the Addl DGP CBCID or the 5th respondent also has not registered the FIR based on the petitioners complaint dated 14.11.2013 & 16.11.2013 against the cognizable offences U/s.120B, 420, 306 IPC which is illegal, arbitrary, unjust, unfair and violative of principles of natural justice under Articles 14, 16, 21 of the Constitution of India and violate the findings of the Hon'ble Apex Court judgment in LALITHA KUMARI vs GOVT OF UP & TVG Chandrashekar Vs State of AP & State of Haryana VS Bhaianlal & A V Santosh Kumar Vs Sajid Hussain (W.P.No.

35368 of 2013). Consequently, the Hon'ble High Court may be pleased a) to direct either 4th or 5th respondents to register the FIR against the 6th and 7th respondents based on the petitioners complaint dated 14.11.2013, 16.11.2013 for the purpose of conduct the enquiry and investigation against the both respondents to collect the amount Rs.9,41,000/- (Rupees Nine lakhs and forty one thousand only) from the said company." A perusal of the proceeding sheet discloses that on 30.01.

CKR, J W.P.No.2244 of 2014 the petitioner on 09.11.2013 as an FIR and to conduct investigation into the same.

A counter-affidavit is filed by the fifth respondent stating that pursuant to the directions issued by this Court, based on the contents of the alleged complaint of the petitioner, Crime No.523 of 2013 was registered for the offences punishable under Sections 406 and 420 IPC, on the file of Narayanaguda Police Station. In the light of the above, it is evident that the very purpose of filing this Writ Petition had already been served. Accordingly, this Writ Petition is closed.

Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
