THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.27301 of 2017 ORDER:

Heard Sri Srinivas Ambati, learned counsel for the petitioners, learned Government Pleader for Municipal Administration and Urban Development (AP) for respondent No.1 and Sri N.Venkateswarlu, Standing Counsel for respondent No.2 and learned Government Pleader for Revenue (AP) for respondent No.3. 2.

According to the petitioners, they are the absolute owners of the subject properties situated in Sy.No.20 of Chinnaravuru Village, Tenali Mandal, Guntur District, which fall under the municipal limits of the second respondent.

When the matter is taken up, on instructions, it is submitted by the learned Standing Counsel for the second respondent that the second respondent-Municipality will issue notices to the petitioners herein and hold enquiry, if there is requirement of acquiring the properties of the petitioners for the public purpose, and the petitioners can participate in the enquiry.

Recording the statement of the learned Standing Counsel for the second respondent, this writ petition is disposed of directing the second respondent to issue notices to the petitioners, hold enquiry with regard to the subject properties and to pass a final order in accordance with law. However, pending such enquiry, no coercive action will be taken by the respondents.

Consequently, miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs.
