Heard the learned counsel for the petitioner and the learned Public Prosecutor.
2. The present Criminal Petition came to be filed by the petitioner/A.1 under Sections 437 and 439 of the Code of Criminal Procedure, 1973, seeking enlargement on bail in connection with Crime No.38 of 2015 of K.D.Peta Police Station, Visakhapatnam District, registered for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
3. It is represented by the learned counsel for the petitioner that the trial Court has not taken into consideration the medical certificates filed by the petitioner showing pregnancy of his wife, while rejecting the bail application as the same is not reflected in the order and hence seeks permission to withdraw the criminal petition, to raise the same before the trial Court again.
3. Permission as sought for is accorded.
4. Accordingly, the Criminal Petition is dismissed as withdrawn giving liberty to the petitioner to move an application for bail before the trial Court raising all pleas, in which event the same shall be dealt with at the earliest, in accordance with law. _______________________ JUSTICE C.
