laas_734_2007 JUDGMENT (per Hon'ble Sri Justice C.V.Nagarjuna Reddy): This appeal is filed by the Singareni Collieries Company Limited, RG - II Area, Godavarikhani, feeling aggrieved by order and decree dated 22-01-2007 in O.P.No. 6 of 2004 on the file of the Court of Senior Civil Judge, Manthani. 2.
The dispute between the parties was referred to the High Court Lok Adalat which has passed award dated 14-03-2015, whereunder it is reported that both parties have agreed for fixing the market value of the acquired lands at Rs.1,19,000/- per acre. A perusal of the award shows that this settlement was reached between the appellant and majority of the respondents in the appeal. The award referred to the respondents who are excluded from its purview. Learned counsel for the respondents, who are excluded from the award, submitted that some of those respondents have died pending the appeal and that their legal-representatives have been brought on record. He has filed memo dated 13-03-2017, wherein it is stated that respondent Nos. 141, 153, 154, 164, 171, 173, 179, 193, 194, 195, 221, 229, 230 and 231 are surviving and 48 respondents indicated in tabular column have died and in their place, their legalrepresentatives have been brought on record whose status as respondents is also mentioned in the said table.

Sri S.Prabhakar Reddy, learned counsel, submitted that all the surviving respondents and the legal-heirs of the deceased respondents, who have been excluded from the purview of the Lok Adalat award, have agreed to accept the quantum of compensation fixed under the Lok Adalat award and that the appeal may be disposed of in terms of the said award. He has further submitted that he is representing all the excluded respondents from the Lok Adalat award or their legal-representatives and that the appeal may be disposed of in terms of the aforementioned Lok Adalat award.

Therefore, this appeal is disposed of in terms of the Lok Adalat award dated 14-03-2015 with the direction that the said award shall form part of this judgment and the compensation in respect of the lands of the respondents, who are not covered by the Lok Adalat award, is fixed at Rs.1,19,000/- per acre for both DC/SC wet lands together with all statutory benefits. ________________________ C.V.NAGARJUNA REDDY, J.
