THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4818 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in connection with crime No.192 of 2014 on the file of the Police Station, Chimakurthy, Prakasam District, registered for the offence under Section 379 IPC. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
The allegation against the petitioner is that the petitioner was found in possession of the gold chain of 10 grams. Except the said allegation, nothing is alleged against him. Further, there are no criminal cases are pending against him. Having regard to the facts and circumstances of the case and the nature of allegations against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner herein.
In the circumstances, the petitioner/accused is directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioner/accused is directed to report before the Station House Officer concerned as and when required.
