Sk.Babuddin v. The Andhra Pradesh State Civil Supplies

2016-11-09M.S.Ramachandra Rao1 pages

THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.38657 of 2016 O R D E R:

Heard counsel for the petitioner and Sri K.Raghu Babu, Standing counsel for respondents 1 and 2.

2.

Petitioner had filed this Writ Petition challenging the proceeding dt.01.08.2016 issued by the 2nd respondent suspending the petitioner pending enquiry.

3.

Though counsel for the petitioner contends that no prior notice was issued before placing the petitioner under suspension pending enquiry, he is unable to show any rule or precedent which mandates giving of such notice before placing an employee under suspension pending enquiry. 4.

Therefore, I am not inclined to grant such relief. However, the respondents 1 and 2 shall commence and conclude the enquiry proposed against the petitioner in compliance with service regulations and principles of natural justice within a period of two (02) months from the date of receipt of a copy of this order.

5.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

6.

Consequently, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
