THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.28009 of 2019 O R D E R:

The present writ petition is filed seeking a direction to the 1st respondent-Government to take a decision on the Inspection Report submitted by the 2nd and 3rd respondents in file, bearing Lr.Rc.No.005/HPC/2019, with regard to grant of No Objection/Essentiality Certificate to the petitioner-Institution for establishment of Nursing Institution at Hanamkonda with an intake of 50 seats per year for B.Sc. Nursing.

2.

Heard the learned counsel for the petitioner-Institution and the learned Government Pleader for Medical and Health. 3.

Learned Government Pleader for Medical and Health expresses his difficulty to make submissions in the matter and states that despite addressing a letter to the 1st and 2nd respondents on 20.12.2019, no instructions have been received in the matter till date. 4.

On the other hand, learned counsel for the petitioner-Institution has produced before this Court, a copy of the letter in Lr.Rc.No.005/HPC/2019, dated 30.05.2019, addressed by the 3rd respondent to the 1st respondent-Government. It is evident from the said letter that the High Power Committee appointed by the Principal, Kakatiya Medical Institution, Warangal, had conducted inspection of the petitioner-Institution, on 18.04.2019, and based on their recommendation, the 3rd respondent has addressed the said letter to the 1st respondentGovernment. Inasmuch as the said report is pending for approval of the

1st respondent since June, 2019, this Court is of the opinion that a direction needs to be given to the 1st respondent to act on the said report. 5.

Accordingly, the 1st respondent is hereby directed to take a decision on the report forwarded by the 3rd respondent with regard to grant of No Objection/Essentiality Certificate to the petitioner-Institution for establishment of Prashanti College of Nursing at Hanamkonda, in accordance with the Rules and the Government Orders in vogue, within a period of two (2) months from the date of receipt of a coy of this order. 6.

Subject to the above observation, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
