THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI CONTEMPT CASE No.1749 OF 2019 O R D E R :

When the matter is taken up for hearing, learned Government Pleader appearing for the respondents informed the Court that pursuant to the order passed by this Court in W.P.No.12497 of 2018, dt.24.04.2019, the case of the petitioner was considered and permitted him to participate in the physical examination test. But the petitioner could not clear the physical examination test and consequently he was disqualified vide proceedings dated 23.11.2019. Learned counsel for the petitioner has also not disputed the said submission.

In view of the above, this Court is of the considered view that the order passed by this Court in W.P.No.12497 of 2018, dt.24.04.2019 has been complied with.

Accordingly, the Contempt Case is closed. However, the petitioner is at liberty to challenge the disqualification proceedings dt.23.11.2019 in accordance with law. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
