THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 288 OF 2017 O R D E R :

This Writ Petition is filed alleging that the respondent authorities are trying to demolish the petitioners' property situated at Ward No. 30, Block No. 70 in Survey No.107/2 of Ramanayyapet, Kakinada.

When the matter came up for admission on 06.01.2017, at the instance of the learned Standing Counsel for the respondent Municipal Corporation, it was directed to be listed after Sankranti Vacation, 2017.

Today, when the matter is taken up for hearing, learned counsel for the petitioners submits that to a large extent, demolition has been carried out by the respondent authorities and they are not permitting the petitioners to make construction in accordance with the sanctioned plan.

On the other hand, the learned Standing Counsel, on instructions, submits that since the construction was made in the premises, which was earmarked as open space, the permission sanctioned earlier was revoked by the proceedings dated 30.12.2016, a copy of which has been made available, across the Bar, to the learned counsel for the petitioners. At this stage, the learned counsel for the petitioners requests that his clients may be given liberty to challenge the revocation order dated 30.12.2016.

Having considered the respective submissions and also the request of the learned counsel for the petitioners, the Writ Petition

is closed leaving liberty to the petitioners to work out their remedies as against the revocation order dated 30.12.2016. No costs.

Consequently, the miscellaneous Applications, if any shall also stand closed.
