THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8176 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail to the petitioners, who are arrayed as Accused Nos.3 and 4 in the event of their arrest in Crime No.95 of 2019 on the file of Station House Officer, Dichpally Police Station, Nizamabad District registered for the offences punishable under Sections 417, 420 and 376 read with Section 90 of Indian Penal Code.

Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The complaint was filed alleging that the Accused No.1 promised to marry the deceased and also was having sexual intercourse with the deceased, which resulted in pregnancy. The said pregnancy was terminated twice. However Accused No.1 refused to marry the deceased for which reason she committed suicide.

The allegation against these petitioners is that they have supported Accused No.1 when he refused to marry the deceased. 5.

In the said circumstances, the petitioners/Accused Nos.3 and 4 can be granted the relief of anticipatory bail. 6.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.3 and 4 are granted anticipatory bail subject to the following terms and conditions:

i) The petitioners/Accused Nos.3 and 4 are directed to surrender before the Station House Officer, Dichpally Police Station, Nizamabad District within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.3 and 4 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks or till filing of charge sheet whoever is earlier.

iii) The petitioners/Accused Nos.3 and 4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any, pending shall stand closed. _____________ K.SURENDER, J Date: 20.09.2022 ns
