THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.5863 of 2015 ORDER:

The petitioner herein is the defendant in O.S. No.16/2011 on the file of the Court of the learned Junior Civil Judge, Narayanapet, Mahabubnagar District. The said suit was filed by respondent No.1 herein for permanent injunction in respect of an extent of Ac.2.01 guntas in Survey No.34/A situated at Edevelly Village, Utkoor Mandal, Mahabubnagar District. Along with the suit, respondent No.1 herein filed I.A. No.25/2011 seeking temporary injunction, and the same was granted. Challenging the same, the petitioner herein filed C.M.A.No.3/2011 before the Court of the learned Senior Civil Judge, Narayanapet, and the judgment and decree, granted on 07.07.2011, was confirmed by order dated 27.10.2015. Challenging the same, the present Civil Revision Petition was filed.

In view of the concurrent findings of fact in a suit for permanent injunction granting temporary injunction in favour of respondent No.1, this Court is not inclined to admit the present Civil Revision Petition. However, as the suit is of the year 2011, learned Junior Civil Judge, Narayanapet is directed to dispose of the suit as expeditiously as possible, but not later than 30.04.2016 without being influenced by the observations made in I.A. No.25/2011 or in C.M.A. No.3/2011.

With the above observations, this Civil Revision Petition is dismissed. No order as to costs.

Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
