THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITON No.24991 of 2018 ORDER:

Heard learned counsel for the petitioners and the learned Government Pleader for Fisheries.

The grievance of the petitioners, in the present Writ Petition, is the inaction, on the part of the fourth respondent, pursuant to the impugned proceedings vide R.Dis.Memo No.3048/E2/2017, dated 20.10.2017, of the Commissioner of Fisheries, Vijayanagar Colony, Hyderabad-second respondent herein.

A counter-affidavit is filed by the District Fisheries Officer, Nalgonda-fourth respondent herein. The contents of the said counter, to the extent of their relevance to the present Writ Petition, are as under:

"Reply to para No.5. It is to submit that, the Chirumarthy Village is a free village not covered under area of operation of any Society. The Gramapanchayat Authorities have also adopted a Resolution on 19.06.2017 stating that, they have no objection for the Organization of the proposed Society at Chirumarthy and leasing out the Peddavoorachervu of their village to the proposed FCS at Chirumarthy for undertaking fish culture by the petitioners herein. The main allegation of the rivalry group in the village is in regard with the Community of the proposed Society members. The issue has been referred to the Revenue Authorities/Tahsildar/Revenue Divisional Officer to confirm the fact of caste of the members identified during the course of skill test to make an end to these allegations. The Revenue Authorities through i.e.

Tahsildar, Madgulapally Mandal has confirmed the caste of petitioners as Mudiiraj Community after thorough verification of the records and confirmed all the persons belongs to Mudiraj caste (copy enclosed). As such, the allegations made by a

group of persons those who not at all connected with the issue needs no further action. It is established from the certification of the Tahsildar that, the allegation is baseless. In view of the above, the issue of organization and registration of the proposed Society at Chirumarthy has been set in motion and the same is in process. Meantime, the petitioners herein have approached the Hon'ble High Court of Telangana State at Hydrabad by filing this Writ Petition seeking a direction to the respondent No.4 for early registration of the proposed Society under TSCS Act and Rules. The matter is sunder active consideration by the respondent No.4 as prayed for by the petitioners herein". Having regard to the submissions made by the learned counsel on either side, and in view of the above contents of the counter-affidavit, Writ Petition is disposed, with a direction to the fourth respondent herein to finalize the present issue, as expeditiously as possible. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
