THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.3566 OF 2009 ORDER:

This writ petition is filed seeking to issue writ of mandamus declaring the action of the 3rd respondent in not receiving the application in Form 'K' for issuance of dispatch permits and in not issuing dispatch permits for transportation of Black Granite in over an extent of Ac.1.00 Hects. In Sy.No.369 & 374 of Thatikal village, Nakrekal Mandal, Nalgonda District in pursuant to lease granted in Proc. No.14453/R71/2008-1, dated 27-06-2008 as arbitrary, illegal and contrary to Mines and Minerals (Development & Regulation) Act, 1957 and A.P. Minor Mineral Concession Rules, 1966.

2. This Court while admitting the writ petition on 24-02-2009, passed interim order which reads thus: "There shall e interim direction to 3rd respondent to consider issuing dispatch permits for transportation of mineral Black Granite from the leased area in an extent of Ac.1.00 Hects. In Sy.No.369 & 374 of Thatikal village, Nakrekal Mandal, Nalgonda District, and pass appropriate orders as per law, within a period of ten days from the date of receipt of a copy of this order."
