HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 2838 OF 2015 O R D E R :

This writ petition is filed by the petitioner to declare the action of the respondents in interfering with the personal liberty of the petitioner and her family by calling to the Police Station at the instance of the fourth respondent, against whom the petitioner has already lodged a complaint on 04-2-2015 and to settle the dispute of granting leasehold rights to the fourth respondent as illegal, arbitrary and is in violation of Article 21 of the Constitution of India and consequently to direct the respondents not to interfere with the personal liberty of the petitioner or her family members without there being any crime is registered and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned Government Pleader for Home [AP] representing the State/respondents 1 to 3.

3. It is the case of the petitioner that the third respondent under the influence of fourth respondent is interfering with the peaceful possession and enjoyment of the petitioner and the petitioner also lodged a complaint on 04/2/2015 against him and the same is pending.

4. On the other hand, Sri Ramesh Babu, the Assistant Government Pleader on written instructions dated 19-2-2015

submits that no such complaint has been received in the Police Station from the petitioner and the police are not interfering with the possession of the petitioner.

5. Recording the above submission of Assistant Government Pleader for Home, this writ petition is dismissed. No costs.

6. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
