Heard Mr. Murthy holding for Mr. S.Ravindranath, for petitioner, Mr. Peri Prabhakar for 1st respondent and the learned Assistant Government Pleader (Labour) for Respondents 2 and 3.
2. The petitioner prays for mandamus declaring the action of 2nd respondent for maintaining and adjudicating ID No.91 of 2009, an individual dispute raised under Section 2(A)(2) of the Industrial Disputes Act (For short 'the Act'), in view of the very same dispute covered by reference of the Government through G.O.Rt.No.682 dated 08.11.2016, as illegal and without jurisdiction.
3. At the time of hearing, Mr. Murthy places on record the common award passed by 2nd respondent in ID No.187 of 2009 & batch dated 27.07.2016, declining relief to the workmen, Mr. Prabhakar, seeks liberty to raise all grounds available against the award dated 27.07.2016 by pursuing reliefs to which the 1st respondent is entitled in law against ID No.187 of 2009 dated 27.07.2016. The interim stay granted in WP MP No.22766 of 2009 is vacated.
4. By granting the liberty and with consent, the writ petition is ordered directing 2nd respondent to dispose of ID No.91 of 2009 as expeditiously as possible, preferably, within three months from the date of receipt of a copy of this order.
