HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SMT JUSTICE T. RAJANI C.M.A. No. 201 of 2006 JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) The order dated 16.11.2017 passed by this Court reveals that the learned counsel for the respondent submitted that Sri G.Dharma Rao, learned counsel for the appellant, expired. Hence, the Registry was directed to serve notice on the appellant without process fee. In pursuance of this order, the Registry sent notice to the appellant, however the same has been returned unserved with an endorsement " insufficient address" .
Inasmuch as nobody has appeared from the office of the learned counsel for the appellant nor has the appellant himself made any representation, this Court has no option but to dismiss the appeal for non-prosecution.
Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
