HON'BLE SRI JUSTICE U. DURGA PRASAD RAO WRIT PETITION No.9412 of 2009 ORDER:
The petitioner seeks writ of Prohibition stalling further proceedings of Regional Provident Fund Commissioner in the matter of applicability of EPF and NND Agents and declare the proceedings under Section 26(B) of EPF and MP Act, 1952 as illegal, arbitrary and in violation of principles of natural justice and consequently nullify the order P/6075/ ENF/KDP/SRO/KDP/ENF/2008/2083, dated 6.2.2009. 2.
The respondents filed counter and opposed the writ petition. 3.
This Court, in WPMP No.12298 of 2009 passed an interim order on 30.4.2009 to the effect that the enquiry as contemplated under the Act may go on and that final orders may not be passed until further orders.

When the matter came up for hearing today, learned Standing Counsel for first respondent would submit, enquiry was completed and in view of the interim orders of this Court, final order is not passed. Both the parties would agree that the Regional Provident Fund Commissioner may pass final orders, so that, the aggrieved party may take appropriate course of action available to them under law. 5.
In that view, this writ petition is disposed of directing the Regional Provident Fund Commissioner to pass orders pursuant to his enquiry, so that, aggrieved party can take appropriate course of action available under law.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
