HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10995 OF 2016 ORDER:

This writ petition is filed challenging the action of respondent No. 3 in suspending the petitioner's authorization of Fair Price Shop No.238 of Lakshmipur Village, Manakondur Mandal, Karimnatgar District pending enquiry and to direct the respondents to continue the petitioner as fair price shop dealer. It is the case of the petitioner that a show-cause notice dated 20.03.2016 was issued to him alleging certain irregularities, to which, he submitted his explanation. Dissatisfied with the same, the 3rd respondent by order dated 20.03.2016 suspended the authorization of the petitioner's fair price shop. A perusal of the proceedings dated 20.03.

2016 of the 3rd respondent shows that the authorization of the petitioner's fair price shop was suspended on the allegation of the petitioner indulging in clandestine business and contravened conditions of the Essential Commodities Act. As the allegations leveled against the petitioner are serious in nature, 3rd respondent-RDO shall conduct an enquiry against the petitioner by taking into consideration of the explanation submitted by the petitioner.

In the light of the aforesaid discussion and inasmuch as the petitioner has already submitted his explanation denying the charges leveled against him, the 3rd respondent-RDO is directed to consider the explanation submitted by the petitioner and pass final orders within a period of four weeks from the date of receipt of a copy of this order by duly observing the principles of natural justice and affording opportunity of being heard to the petitioner. With the above direction, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in the writ petition, shall stand closed. ______________________________ CHALLA KODANDA RAM, J.
