HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.6730 of 2004 ORDER:

This Writ Petition is filed challenging the orders of removal passed by the Disciplinary Authority dated 18.03.2004. The counsel appearing for the petitioner contends that the petitioner was appointed as a Driver during the year 1992 and the services of the petitioners were removed in the year 2004 on the ground that the petitioner has produced a false caste certificate and challenging the same, the present Writ Petition is filed. The counsel for the petitioner contends that appropriate orders be passed by setting aside the order of removal and the petitioner be reinstated into service.

This court having considered the said submissions, is of the considered view that the relief sought by the petitioner to reinstate the petitioner into service at this point of time may not be feasible as the petitioner has attained the age of superannuation during the pendency of this Writ Petition. Therefore, the relief sought for by the petitioner to reinstate him into service is not feasible. However, this Writ Petition can be disposed of directing the respondents to pay the service benefits to the petitioner for the service rendered by the petitioner from 1992 to 2004; if not already paid, within a period of four weeks from the date of receipt of copy of this order.

With these observations, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. No order as to costs.
