THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY A.S.M.P.No. 679 OF 2016 IN/AND A.S.No. 727 OF 2008 COMMON JUDGMENT:

A.S.M.P.No. 679 of 2016 is filed seeking permission to withdraw the appeal contending that the claim of the respondent-plaintiff was settled by the borrowers and the bank has issued letter confirming that the action has been closed under SBI-OTS Scheme 2015-16 for Rs.3,10,000/-. Thus, nothing is required to be decided by this Court in the present appeal and sought for permission to withdraw this appeal.

As the matter is settled outside the court, the liability of the appellants to pay the suit claim to the respondent-plaintiff does not arise. Accordingly, A.S.M.P.No. 679 of 2016 is allowed and the appeal is dismissed as withdrawn acceding to the request of learned counsel for the appellants but without costs. Pending miscellaneous petitions, if any, in this appeal shall stand dismissed in consequence.
