HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CMA No. 1397 of 2004 Judgment:

As seen from the proceeding sheet, on the representation made by the learned counsel for the appellant on 08.11.2012, this Court recorded that the appellant expired and, at the request of the learned counsel for the appellant, to bring LRs of the deceased appellant on record, four (4) weeks time was granted. Even after expiry of three years period thereafter, learned counsel for the appellant still seeks time to bring LRs of the deceased appellant on record.

2. Since the sole appellant expired and 90 days period within which LRs have to be brought on record subject to other Codal Rules also expired, the abatement automatically works out. Therefore, the instant appeal stands abated. There shall be no order as to costs.

3. As a sequel thereto, Miscellaneous Applications, if any, pending in this appeal shall stand closed.
