THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER C.M.P. No.705 of 2013 ORDER:
This petition is filed under Section 24 of C.P.C. to withdraw O.S.No.201 of 2012 (Old O.S.No.948 of 2008) on the file of the Additional District Court, Vikarabad and transfer the same to the file of the I Additional District Court, Ranga Reddy District at L.B.Nagar to be tried along with O.S.No.600 of 2013 (Old O.S.No.160 of 2008).
2. When the matter is taken up for hearing, learned counsel for both the parties submitted that O.S.No.160 of 2008 which was pending on the file of the Junior Civil Judge Court at Chevella, Ranga Reddy District was transferred to I Additional District Court, Ranga Reddy District at L.B.Nagar in pursuance of the order passed by this Court in Tr.C.M.P.No.156 of 2010. By the time of allowing of the transfer petition, O.S.No.201 of 2012 (Old O.S.No.948 of 2008) is pending on the file of the I Additional District Court, Ranga Reddy District at L.B.Nagar. After establishment of Additional District Court at Vikarabad, O.S.No.201 of 2012 (Old O.S.No.948 of 2008) was transferred to Additional District Court, Vikarabad whereas O.S.No.600 of 2013 (Old O.S.No.160 of 2008) is pending on the file of the I Additional District Court, Ranga Reddy District.
3. Learned counsel for both the parties in one voice submitted that O.S.No.600 of 2013 (Old O.S.No.160 of 2008) may be transferred to Additional District Court, Vikarabad in view of pendency of O.S.No.201 of 2012 (Old O.S.No.948 of 2008).
4. In view of the submissions made by learned counsel for both the parties, the Transfer Civil Miscellaneous Petition is disposed of, withdrawing O.S.No.600 of 2013 (Old O.S.No.160 of 2008) from the file of the I Additional District Court, Ranga Reddy District at L.B.Nagar and transferred to the file of the Additional District Court, Vikarabad for disposal in accordance with law. There shall be no order as to costs.
5. Consequently, Miscellaneous Petitions, if any, pending in this Transfer Civil Miscellaneous Petition, shall stand closed.
