THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Arbitration Application No.70 of 2015 ORDER:

This Arbitration Application is filed under Section 11(6) of the Arbitration and Conciliation Act, 1996, to appoint a sole arbitrator. The deed of development agreement, dated 28.04.2011 contains an arbitration clause in Clause 20(1), and requires the matter to be resolved by a panel of three arbitrators.

Both Sri G.Durga Bose, Learned Counsel for the applicant, and Smt.D.Pramada, Learned Counsel for the respondents, would request this Court to appoint a sole arbitrator, and agree that Sri V.V.Raghavan, Retired District Judge, be appointed as the sole arbitrator to resolve the disputes between the parties.

As both Counsel are in agreement, I consider it appropriate to appoint Sri V.V. Raghavan, Retired District Judge, No.302, Legends Residency, Street No.2, Shantinagar, Masab Tank, Hyderabad - 500 028, as the sole arbitrator. The Learned arbitrator shall fix his remuneration, and incidental charges for the arbitration proceedings, in consultation with the parties. He shall complete arbitration proceedings, and pass an award at the earliest, preferably within a period of six months from the date of commencement of arbitral proceedings. He is also requested to hold sittings, as far as possible, in the mediation centre of the High Court.

The Arbitration Application is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
