THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.30073 OF 2016

O R D E R

The petitioner in this writ petition is seeking for a direction to the 2nd respondent - Sub Registrar not to entertain the sale deed being presented by the 3rd respondent for registration of subject land. Heard the counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

From the writ averments, it could be seen that the petitioner has already filed suit in O.S.No.208/2011 on the file of III Additional District Judge Court, Ongole for specific performance in respect of land in question and the same is pending adjudication. In the said, petitioner filed I.A.No.38/2011 in O.S.No.208/2011 for injunction and the same is also pending. In view of these circumstances, I am of the considered view, that the petitioner cannot pursue parallel litigation and the writ petition is liable to be dismissed and accordingly dismissed.

However it is open for the petitioner to obtain interim orders in the suit filed by her.

No order as to costs.

Miscellaneous petitions pending if any, shall stand closed. AVS ------------------------------------- 08-09-2016
