Kokku Buchaiah v. The State Of Telangana,
THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.5921 of 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
Though the earlier Writ Petition of the petitioner in W.P.No.23919 of 2015 was considered and disposed of on 31.07.2015 directing the Tahsildar, Farooqnagar Mandal, Mahabubnagar District, the 2nd respondent, to fix an early date for hearing and disposal of the tenancy case expeditiously, the petitioner has once again moved this Writ Petition complaining that the 2nd respondent is not considering the tenancy case or the interim application.
I do not see any justification for the petitioner to move this Court in spite of the directions already issued in the earlier Writ Petition, as referred to above, and the 2nd respondent is bound to comply with the earlier order. Hence, no further direction to the 2nd respondent is called for. However, the petitioner states that pending the tenancy case, the 3rd respondent is converting the agricultural land to nonagricultural purpose without there being any approval from the competent authority under the Andhra Pradesh Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 (for short, 'the Act'). If that be so, it is for the petitioner to make a complaint before the competent authority under the Act, but there is no reason to once again direct the 2nd respondent when already directions were given for early hearing and disposal of the tenancy case. Hence, there is no reason to
entertain the Writ Petition.
The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
