HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.28406 OF 2017 O R D E R :

This writ petition is filed challenging the proceedings dated 28.06.2017 issued by the 1st respondent, wherein the appeal filed by the petitioner was rejected as time barred. Learned counsel for the petitioner submits that though the petitioner has raised many grounds in the appeal, the respondents have not considered the appeal of the petitioner on merits as directed by the Division Bench of this Court in WA.No.386/2017 and WP.No.4263/2017 dated 28.03.2017. Learned Standing Counsel appearing for the respondent Corporation submits that since there was delay in preferring the appeal by the petitioner, the appeal is rejected as time barred. He also submits that against the impugned proceedings, petitioner has alternative remedy of review.

It is to be seen that nothing is placed before this Court to show that any condone delay petition is filed by the petitioner. The Division Bench of this Court passed orders on 28.03.2017 directing the respondent Corporation to dispose of the appeal which is pending by then.

In view of the above and since it is stated that the petitioner has alternative remedy of review, this Court is not inclined to entertain the writ petition. However, it is open for the

petitioner to avail alternative remedy of review under the Regulations.

Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 30.08.2017 t k
