THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN WRIT APPEAL No.983 of 2018 JUDGMENT: (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) After arguing the matter for quite a long time, learned Senior Counsel for the appellant sought leave to withdraw the Writ Appeal without prejudice to the appellant pulling down the objectionable construction, to which the appellant undertakes, and thereafter apply for grant of building permit as may be permissible in law, for the remaining structure. The Writ Appeal is, hence, dismissed as withdrawn in the light of what is stated above clarifying that the appellant will be entitled to enjoy the benefit of any statutory provision to the extent sought for hereinabove.
