HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.671 of 2014 ORDER:

Heard learned counsel for the petitioners and learned Public Prosecutor representing the 1st respondent-State and learned Counsel for the 2nd respondent.

The petitioners are accused Nos.2 & 3 parents in law of the defacto complainant and parents of A.1, husband of the defacto complainant in CC.No.534 of 2013 pending on the file of learned X Metropolitan Magistrate, Cyberabad at Malkajgiri, Ranga Reddy District, registered and taken cognizance for the offences punishable under Sections 498-A IPC and Sections 4 & 6 of Dowry Prohibition Act outcome of crime No.447 of 2012 of Neredmet Police Station, Cyberabad.

The quash petition was filed impugning the police final report with cognizance. Pending the same all through with no stay, but for dispensing with the personal appearance other than as and when required by the trial Court, later charges framed after hearing both sides and trial also undisputedly in progress.

Having regard to the above, this Criminal Petition is disposed of by left open all defences by confirming the interim order referred supra of dispensing with the presence, but for personal appearance as and when required including for Section 313 Cr.P.C. examination and in defence evidence.
