HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32823 of 2011 ORDER:

Heard learned counsel for the petitioners, Government Pleader for Assignment and Government Pleader for Revenue. With the consent of all the parties, the main writ petition itself is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondents in demarcating the boundaries of the land assigned to the petitioners by way of D-form pattas with regard to land in Sy.Nos.805 and 1001 of Kadivedu Village, Chillakur Mandal, SPSR Nellore District, as illegal and arbitrary.

Though various grounds are raised in the writ petition, learned counsel for the petitioners submits that the petitioners made a representation dated 27.10.2011 to the fifth respondent for conducting survey and demarcation of the land, but till today no orders are passed. Hence, he seeks a direction to the fifth respondent to act on the representation of the petitioners. Though no counter is filed but the Government Pleader for Revenue on oral instructions submits that if the representation is not considered till date, the fifth respondent would act on the representation in accordance with law.

Without going into the merits of the case and having regard to the circumstances stated above, the writ petition is disposed of directing the fifth respondent to act on the representation dated 28.10.2011, if any made by the petitioners with regard to conduct of

survey and demarcation of land in Sy.Nos.805 and 1001 of Kadivedu Village, Chillakur Mandal, SPSR Nellore District and pass orders in accordance with law within a period of twelve (12) weeks from the date of receipt a copy of this order. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
