THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8108 OF 2016 ORDER:

This petition is filed by the petitioners under Section 438 of Cr.P.C. seeking to grant anticipatory bail to them in an unregistered crime.

It is stated that the 1st petitioner is the General Manager and the 2nd petitioner is the Assistant General Manager in District Co-operative Central Bank, Kadapa, YSR Kadapa District, and one PVVN Prasad, who is the Chief Executive Officer, Chinthalamadugupalli, PACS, and his wife obtained loan on the fictitious documents and that the Divisional Co-operative Officer conducted enquiry and found that the said persons are not eligible for the loan and he recommended to take action against the bank employees and revenue officials. Learned Additional Public Prosecutor submitted that no crime was registered against the petitioners.

Considering the facts and circumstances of the case and in view of the fact that no crime was registered against the petitioners, this Court is not inclined to grant the relief sought by the petitioners.
