O R D E R

The prayer of the petitioner in this case is as under: 'For the reasons stated in the accompanying affidavit the petitioner prays this Hon'ble Court may be pleased to issue appropriate writ, order or direction particularly one in the nature of Writ of Mandamus declaring the action of the respondents in frequently coming to house of the petitioner and calling to the police station, without there being any crime registered, as, arbitrary, illegal and unconstitutional and to pass such other order or orders as this Hon'ble Court deem fit and proper in the circumstances of the case.'

The Inspector of Police, Mirchowk Police Station, Hyderabad, filed a counter-affidavit denying the allegations leveled by the petitioner to the effect that the police authorities are interfering with his life and liberty without the sanction of law. The Inspector further stated that a suspect sheet had been opened in the name of the petitioner on the file of Mirchowk Police Station. However, he admitted that as of now no case was registered against the petitioner on the file of the said police station and that he was not required in connection with any case pending on its file.

The aforestated stand of the police authorities as set out in the aforestated counter-affidavit is duly taken on record. In the light thereof, adjudication of this case on merits is not warranted. Sri Mohd. Islamuddin Ansari, learned counsel for the petitioner, is also agreeable to the closure of the case recording the aforestated stand of the police authorities. The learned counsel would also seek leave to permit his client to take recourse to appropriate remedies in accordance with law as regards the suspect sheet opened against him. The writ petition is accordingly closed with the liberty aforestated. Pending miscellaneous petitions shall also stand closed. No order as to

costs.
