HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.8253 of 2019 ORDER :

This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in DVC No.6 of 2018 on the file of the Special Mobile Judl. Magistrate of I Class, Khammam.

The 1st respondent herein filed the petition against the petitioner herein-5th respondent in DVC and others under Section 12 of Protection of Women from Domestic Violence Act, 2005.

Though the present Criminal Petition is filed seeking quashing of entire proceedings against the petitioner, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of the petitioner is not in dispute, his presence in the above DVC may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioner herein (5th respondent) in DVC No.6 of 2018 on the file of the Special Mobile Judl. Magistrate of I Class, Khammam, is hereby dispensed with while permitting him to mark his appearance

through his counsel, except on the dates when his presence is specifically required by the said Court.

With the above direction, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
