THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 17324 OF 2017 ORDER:

Heard learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for second respondent-G.H.M.C.

This writ petition is filed questioning the show cause notice dated 17.05.2017, issued under Section 622 of the G.H.M.C. Act.

Learned counsel for the petitioner submits that by notice dated 17.05.2017, only 24 hours time was granted to the petitioner for submitting the reply and in the meanwhile the respondents are trying to demolish the swimming pool. Aggrieved by the same, the present writ petition is filed. Learned Standing Counsel submits that the petitioner may be granted two weeks time for filing reply and after filing reply, respondents will consider the reply and then necessary action will be taken.

In view of the above submissions, the petitioner is permitted to file reply to the show cause notice dated 17.05.2017, within a period of two weeks from today and on filing of such explanation, the Assistant Medical Officer of Health, Circle 12, Serilingampally, G.H.M.C., shall consider the same and pass orders after giving an opportunity of hearing to the petitioner. Till passing of such orders, there shall be stay of all further proceedings.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
