THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 8406 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.167 of 2022 on the file of Kushaiguda Police Station, Rachakonda, for the offences punishable under Sections 174 of Cr.P.C.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The petitioner is Accused No.1 and his wife committed suicide. The police registered the case of dowry death. 4.

However, as seen from the complaint by the mother of the deceased, she stated that she did not have any suspicion or doubts on anyone being involved in the suicide of her daughter. Further, she came to know that the deceased did not like marriage that they performed with the petitioner who is their nephew.

The petitioner is in jail since 16.08.2022 and the complaint itself reveals that the deceased mother did not have any grievance against this petitioner and also that the death was on account of the deceased not liking the marriage that was performed with this petitioner.

In the said circumstances, this petitioner can be granted the relief of regular bail on the following conditions;

i) The petitioner/A1 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of II Additional Metropolitan Magistrate at Malkajgiri. (ii) The petitioner/A1 shall appear before the concerned Station House Officer, on every Monday between 10.00 A.M. to 1.00 P.M. for a period of six weeks, for the purpose of investigation. iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
