The transfer criminal petition is filed seeking transfer of CC.No.39 of 2016 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad and DVC.No.67 of 2016 on the file of III Metropolitan Magistrate, Erramanzil, Hyderabad to the Family Judge, City Civil Court, Hyderabad to try along with FCOP.No.398 of 2016 and 1089 of 2016.

Heard the counsel for the petitioner; the counsel for the respondents and the learned Public Prosecutor, appearing for the fifth respondent.

A request is made to transfer the above two cases to the Family Judge Court, City Civil Court, Hyderabad on the ground that already there are two cases i.e. FCOP.No.398 of 2016 (filed under Section 9 of the Hindu Marriage Act) and FCOP.No.1089 of 2016 (filed for divorce) pending on the file of the said Court. In view of the above, this Court is of the view that it would be convenient for all the parties to have all the cases tried together in one Court and the respondents also do not raise any objection for the same.

The transfer criminal petition is allowed and CC.No.39 of 2016 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad and DVC.No.67 of 2016 on the file of III Metropolitan Magistrate, Erramanzil, Hyderabad, are hereby transferred to the file of the Family Judge Court, City Civil Court, Hyderabad to be tried together.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
